Terms and Conditions

PAYMENT

We accept all major credit cards, including MasterCard, Visa, American Express and Discover, and PayPal, money orders and checks.

For special and custom orders, we require a 50% deposit at the time of the order and full payment upon delivery.

We offer net 30 payment terms for previous customers with approved credit. Please allow 10 days for processing of credit requests. Please click link to download our Credit Application.

All payments must be made within net 30 days from invoice date. Any account balance due over 60 days from invoice date shall be subject to an additional 1.5% charge of the total invoice amount for each subsequent month until payment in full is received.

  • For orders exceeding $5,000, 50% must be paid with cash, check or credit card before order can be placed.
  • Accounts requiring an increase in credit limit must furnish a new financial statement and/or references.
  •  An additional fee of $35.00 will be charged for returned checks that result from insufficient funds.
  • All shipping fees and taxes are separate from the listed merchandise prices, and shall be incurred (paid) by the customer.

In the event any account is not paid in full within 90 days from invoice date, the customer shall pay all of Tebo Store Fixture’s costs of collection, including prejudgment and post-judgment attorney’s fees and costs, court costs and interest.  By ordering products, customers agree that the sole proper venue for resolution of any disputes between Tebo Store Fixtures and the customer is Denver, Colorado.  Customers thus agree that the state and federal courts located in Denver, Colorado, have jurisdiction over the customer and subject matter of the dispute, customer submits to that jurisdiction, and customer waives the right to assert that courts in any other state or nation have jurisdiction over Tebo Store Fixtures and any dispute involving Tebo Store Fixtures.  Customer agrees that the laws of the State of Colorado and applicable United States federal law, without reference to rules governing choice of laws or the Convention on Contracts for the International Sale of Goods, will apply to any dispute of any sort that might arise between customer and Tebo Store Fixtures.  Customer also waives the right to a jury trial to the fullest extent allowed by applicable law.

All prices are subject to change without notice. The final amount of money due per order is always determined at checkout time, not during shopping cart selection.

  • The customer is always responsible for the most recent product price, even if their selected products are no longer on sale at checkout time.
  • The customer, likewise, assumes responsibility for any missed discounts, for any reason, due to price changes that may occur between product selection and final checkout, whatever that duration may be.

Uniform Commercial Code:

The customer hereby grants a security interest in all products purchased as security for all amounts due from the customer to Tebo Store Fixtures in connection with the purchase of the items and any amounts due from other orders, whether placed before or after the current order.  Said security interest may be perfected by filing a security agreement or a financing statement as provided by the Uniform Commercial Code of the State of Colorado or the location of the products, and customer hereby gives permission to Tebo Store Fixtures to make such filing(s), and agrees that such security interest shall be binding between the parties whether filed or not. Tebo Store Fixtures shall have all rights and remedies provided secured parties in the said Uniform Commercial Code and customer shall comply with all provisions thereof.

 

SHIPPING AND HANDLING

Actual items for sale may vary from their images shown on the website.

We will make every effort to ship orders complete and avoid split shipments. If necessary, we reserve the right to split and/or cancel any item at our discretion.

We attempt to ship out in-stock items by the next working day throughout normal periods of the year, excluding official U.S. holiday periods.

In-stock items are shipped F.O.B. from our warehouse, located at Tebo Store Fixtures, 5771 Logan Street, Denver, CO, 80216, USA.

Out-of-stock and non-stocked items are shipped from the manufacturer.

Items shipped directly from the manufacturer vary in shipment date, requiring six to eight weeks.

For Metro-Denver delivery, we notify the customer of the scheduled delivery date a minimum of 2 days prior to delivery.

While sometimes willing and able to assist, Tebo Store Fixtures and the delivery truck driver are not responsible for unloading. Please provide necessary assistance for facilitating the unloading of the merchandise from trucks.

While Tebo Store Fixtures will assist when possible, the customer is responsible for loading and unloading of personal vehicles, should the customer pick up orders at the warehouse and showroom.

If an order is being delivered using LTL shipment or courier services, the customer shall abide by the specific terms and conditions of service for the selected LTL shipment or courier service.

 

Shipping and handling charges

All shipping costs are separate from the listed merchandise prices, and shall be incurred (paid) by customer.

The standard shipping and handling charge for U.S. deliveries vary depending on the value, weight and dimension of the order.

Shipping costs for all non-online orders shall be estimated upon receipt of customer’s address and a description of the purchased merchandise.

Shipping charges are applied separately on large freight (truck delivery) items.

For ship direct orders, the customer agrees to pay shipping upon arrival of merchandise. Please contact a sales representative for a shipping quote.

All freight estimates are based on current rates. Freight costs at the time of shipping are subject to change in addition to fuel surcharge fluctuations.

 

RETURNS AND EXCHANGES

Written authorization must be obtained from Tebo Store Fixtures before returning, exchanging or canceling orders of any merchandise for any reason.

All returns must have a Return Authorization on the carton and labeled Tebo Store Fixtures, C/O Return Goods Department, 5771 Logan Street, Denver, CO 80216 or it will be refused.

To obtain authorization, customer must send Tebo Store Fixtures an email to info@tebostorefixtures.com, with the order number, to inform Tebo Store Fixtures of cancelation/amendment or return requests, and must receive confirmation of authorization of change/amendment or return of order before returning any merchandise.

Orders must be cancelled within 72 hours of placing the order to receive full refund.

Merchandise purchased by customers located within the Greater Metro Denver Area may not be returned after 10 days from the date of delivery.

Merchandise purchased by customers located outside of the Greater Metro Denver Area may not be returned after 30 days from the date of delivery.

Authorized returns must be shipped back at customer’s expense and are subject to a 20% restocking charge.

The customer shall pay freight or delivery charges on items returned as well as those received. In the case that Tebo Store Fixtures has shipped incorrect merchandise, Tebo Store Fixtures shall pay said charges.

If items are returned due to error by Tebo Store Fixtures, no restocking charge shall be made.

All non-inventory, custom and special order merchandise (including but not limited to showcases, custom manufacturing and kiosks) are not returnable, refundable or available for credit.

 

CUSTOM ORDERS

Custom orders are defined as items not currently stocked in our inventory. This does not apply to items we usually stock but are currently out of stock.

For special and custom orders, we require a 50% deposit at the time of the order and full payment upon delivery.

All non-inventory, custom and special order merchandise (including but not limited to showcases, custom manufacturing and kiosks) are not returnable, refundable or available for credit.

 

DAMAGED GOODS

Should the customer receive damaged merchandise, the customer must first notify the carrier. The customer is responsible for documenting the damage (taking pictures) and filing a claim with the carrier. Please sign the delivery receipt as damaged and Tebo Store Fixtures will facilitate providing replacement merchandise.

Please notify us immediately of all damaged merchandise and provide us with copies of the signed shipping paperwork and pictures taken of damaged packaging and merchandise.

The customer must file and pursue any claim that the customer may have for such damage or loss against the shipping agent. Authorized officers or agents of the customer must be approved before agreement shall be considered binding. Orders may not be cancelled based on merchandise damaged during delivery except by written agreement by an authorized officer of the customer and upon authorization by Tebo Store Fixtures.

 

WARRANTIES

Merchandise sold by Tebo Store Fixtures is provided on an “as is” and “as available” basis. Tebo Store Fixtures makes no representations or warranties of any kind, express or implied, including without limitation:

The implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement;

That the website or the merchandise sold will meet participant’s requirements, will always be available, accessible, uninterrupted, timely, secure, or operate without error;

Any implied warranty arising from course of dealing or usage of trade; and

Any obligation, liability, right, claim, or remedy in tort, whether or not arising from the negligence of Tebo Store Fixtures.

To the full extent permissible under applicable law, Tebo Store Fixtures disclaims any and all such warranties.

 

LIMITATION OF LIABILITY

Tebo Store Fixtures shall never be responsible for improper use or abuse of merchandise sold by it. If any merchandise fails to perform as the merchandise was intended to perform or be used, the sole liability of Tebo Store Fixtures shall be limited to, at Tebo Sore Fixtures’ sole discretion, a full or pro rata refund of the amount paid by purchaser. Under no circumstances will Tebo Sore Fixtures be liable for any special, indirect, incidental, exemplary, punitive, or consequential damages, including:

Without limitation, lost income or profits in any way arising out of or related to this agreement, the website, or the merchandise sold, even if Tebo Store Fixtures has been advised as to the possibility of such damages.

Tebo Store Fixtures shall not be liable for any failure or delay resulting from any governmental action, fire, flood, insurrection, earthquake, act of god, power failure, riot, explosion, embargo, strikes (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slowdown, or any other condition affecting production or delivery in any manner beyond the control of Tebo Store Fixtures.

While Tebo Store Fixtures regularly maintains the information and services it offers on its website and external digital sales platforms, it cannot be held responsible for any errors, defects, lost profits, or other consequential damages arising from the use of this website and external digital sales platforms.

In no event shall Tebo Store Fixtures be liable for any direct, indirect, incidental, consequential, special and exemplary damages, or any damages whatsoever, arising from the use or performance of this website and external digital sales platforms, or from any information, services or products obtained through this website and external digital sales platforms, even if Tebo Store Fixtures has been advised of the possibility of such damages.

Customers acknowledge that Tebo Store Fixtures has entered into the agreement to sell merchandise to customer in reliance upon the limitations of liability set forth herein and that the same is an essential basis of the bargain between the parties.

 

GENERAL PROVISIONS

If any provision of these terms and conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the other terms and conditions and shall not affect the validity and enforceability of any remaining provisions.

Tebo Store Fixtures shall not be considered to have waived any of its rights or remedies unless the waiver is in writing and signed by an authorized agent thereof.  No delay or omission by Tebo Store Fixtures in exercising its rights or remedies will impair or be construed as a waiver, and any single or partial exercise of a right or remedy will not preclude further exercise of any other right or remedy. Tebo Store Fixture's failure to enforce the strict performance of any provision of these terms and conditions, or any other terms applying to a sale, will not constitute a waiver of its right to subsequently enforce such provision or any other applicable terms and conditions.

In the event customer places an order through a third party website or service such as Amazon or eBay, customer and Tebo Store Fixtures shall be bound by the terms and conditions imposed on users of those services to the extent those terms and conditions conflict with these provisions.
